to felony charges of failure to comply and obstructing official business as well
as a misdemeanor DUI charge. Prosecutors dropped additional charges of theft,
resisting arrest and two counts of assault in exchange for the plea.

Assistant County Prosecutor Tony Cillo said during the hearing
that the plea also means prosecutors won’t return to the grand jury to seek
additional charges against Smith stemming from his Jan. 27 arrest.

County Common Pleas Judge Christopher Rothgery said Smith could get up
to 30 months in prison when sentenced later this year and also could have his
driver’s license suspended for the rest of his life. Cillo said he wouldn’t
object to a six-month term of imprisonment for Smith.

On the night of
Smith’s arrest, police were called to the Apples grocery store in Elyria after
the manager said a man later identified as Jeff Marcum wheeled a shopping cart
full of steaks and beer out of the store and began putting them in the cab of
the semi truck that Smith was driving.

to run down Elyria police Officer James Rider. Smith has denied even seeing
Rider.

After the truck was surrounded by police at a stop light on
Cleveland Street, police reported that they had to forcefully remove Smith from
the truck’s cab and wrestle with him to get him into handcuffs.

Smith
contends that he wasn’t fighting with police and was assaulted by Rider, who he
has said hit him twice in the head with a flashlight, and the other officers at
the scene. An internal police investigation cleared Rider and the other officers
involved in the arrest of wrongdoing.

After he was taken into custody,
Smith was taken to EMH Medical Center in Elyria to be treated.

While at
the hospital, Smith was taken to a secure treatment room and handcuffed to a bed
and then told officers with him, including Elyria police Officer Jay Loesch,
that they should have been killed the night Elyria police Officer James
Kersetter was gunned down while responding to a neighborhood disturbance call.

Loesch and Officer Donald Moss were among the officers working March 15,
2010, who responded to Kerstetter’s radio call that he’d been shot.

After Smith made the comment, Loesch and Officer Richard Walker Jr.
closed the door to Smith’s room and Loesch struck Smith once on the left side of
his face, according to a nurse who watched the incident on a monitor at the
nurse’s station that was connected to a camera in the room.In late 2009, the

Smith said
Tuesday that he doesn’t intend to seek bond and will remain in the county jail
until his sentencing. He also said that he intends to seek treatment for his
alcohol use.
